Substance Abuse Prevention on Public Works Projects
Effective January 1, 2008, the Illinois Substance Abuse Prevention on Public Works Projects Act (820 ILCS 265) requires an employer to have a substance abuse prevention program in place before starting work on a public works project. The law also sets forth minimum requirements to be included in the program.
Similarly, the Indiana Drug Testing of Employees on Public Works Contractors law (IC 4-13-18) requires contractors who bid on state public works contracts to submit a written drug testing program with the bid. The program must satisfy certain requirements listed in the law.
